Testaments – inheritance contracts
We provide comprehensive advice in arranging your asset succession and we work closely with you in finding a solution to succession questions that suits your individual needs.
When drafting and checking wills, testaments and inheritance contracts, and also when arranging lifetime asset transfers, our focus is both on achieving the best transfer regulations and on aspects relating to gift tax and inheritance tax in each asset transfer.
Compulsory portion claims
We support you both extra-judicially and also in court in asserting as well as defending against or avoiding/minimising compulsory portion claims and in drafting and checking estate inventories.
Succession
In cases of inheritance there is often conflict between the heirs. It often concerns the division or valuation of the estate or individual parts of the estate. We advise our clients in matters concerning joint heirs, applying for the certificate of inheritance and the assertion and enforcement of inheritance or bequest claims.
Company succession
In cases where companies (or parts thereof) are transferred, we support our clients with succession regulations that are optimised in terms of company law and taxation law. The objective is to achieve a smooth generational change and to preserve the pension security of the person surrendering the company.
Power of attorney / Living will
Inheritance conflicts can sometimes be drawn-out processes that can “block” the bequeathed assets in the long term. In particular for such cases, but also for sudden shortfalls, it is essential to make provisions by means of powers of attorney. Based on a general proxy, you can grant a person of your trust power of attorney in all matters concerning your private assets and healthcare.
Testament executor
A testament executor is responsible for securing, administering and distributing the estate. The testament executor carries out the wishes of the testator.
Appointing a testament executor can help to prevent possible conflicts between relatives. In addition, the execution of a testament safeguards the estate against the codetermination or access by third parties, such as custodians of underage heirs or creditors.
